This book provides an interdisciplinary examination of international law by addressing four critical questions: How are international legal rules distinctive? How does an investigator determine the existence of a rule of international law? Does international law really matter in international politics? and What effect could the changing nature of international relations have on international law? Using Constructivist theory, Arend argues that international law can alter the identity of states, and, consequently, have a profound impact on state behavior.

Nurses are responsible for the well-being and quality of life of many people, and therefore must meet high standards of technical and ethical competence. The most common form of ethical guidance is a code of ethics/professional practice; however, little research on how codes are viewed or used in practice has been undertaken. This study, carried out in six European countries, explored nurses’ opinions of the content and function of codes and their use in nursing practice. A total of 49 focus (...) groups involving 311 nurses were held. Purposive sampling ensured a mix of participants from a range of specialisms. Qualitative analysis enabled emerging themes to be identified on both national and comparative bases. Most participants had a poor understanding of their codes. They were unfamiliar with the content and believed they have little practical value because of extensive barriers to their effective use. In many countries nursing codes appear to be ‘paper tigers’ with little or no impact; changes are needed in the way they are developed and written, introduced in nurse education, and reinforced/implemented in clinical practice. An important work in the debate between materialists and dualists, the public correspondence between Anthony Collins and Samuel Clarke provided the framework for arguments over consciousness and personal identity in eighteenth-century Britain. In Clarke's view, mind and consciousness are so unified that they cannot be compounded into wholes or divided into parts, so mind and consciousness must be distinct from matter. Collins, by contrast, was a perceptive advocate of a materialist account of mind, who defended the possibility that thinking (...) and consciousness are emergent properties of the brain. The doctrine of God is central to theology for it determines the way in which other regions of Christian doctrine are articulated, yet work on this topic in its own right has been occluded recently by treatments of the Trinity or divine passibility. This collection of specially commissioned essays presents major treatments of key themes in the doctrine of God, motivated by but not restricted to the work of Professor Paul S. BackgroundSome people with progressive neurological diseases find they need additional support with eating and drinking at mealtimes, and may require artificial nutrition and hydration. Decisions concerning artificial nutrition and hydration at the end of life are ethically complex, particularly if the individual lacks decision-making capacity. Decisions may concern issues of life and death: weighing the potential for increasing morbidity and prolonging suffering, with potentially shortening life. When individuals lack decision-making capacity, the standard processes of obtaining informed consent for medical interventions (...) are disrupted. Increasingly multi-professional groups are being utilised to make difficult ethical decisions within healthcare. This paper reports upon a service evaluation which examined decision-making within a UK hospital Feeding Issues Multi-Professional Team.MethodsA three month observation of a hospital-based multi-professional team concerning feeding issues, and a one year examination of their records. The key research questions are: a) How are decisions made concerning artificial nutrition for individuals at risk of lacking decision-making capacity? b) What are the key decision-making factors that are balanced? c) Who is involved in the decision-making process?ResultsDecision-making was not a singular decision, but rather involved many different steps. Discussions involving relatives and other clinicians, often took place outside of meetings. Topics of discussion varied but the outcome relied upon balancing the information along four interdependent axes: Risks, burdens and benefits; Treatment goals; Normative ethical values; Interested parties.ConclusionsDecision-making was a dynamic ongoing process with many people involved. The multiple points of decision-making, and the number of people involved with the decision-making process, mean the question of ‘who decides’ cannot be fully answered. There is a potential for anonymity of multiple decision-makers to arise. Decisions in real world clinical practice may not fit precisely into a model of decision-making. The findings from this service evaluation illustrate that within multi-professional team decision-making; decisions may contain elements of both substituted and supported decision-making, and may be better represented as existing upon a continuum. During the set-up phase of an international study of genetic influences on outcomes from sepsis, we aimed to characterise potential differences in ethics approval processes and outcomes in participating European countries. Between 2005 and 2007 of the FP6-funded international Genetics Of Sepsis and Septic Shock project, we asked national coordinators to complete a structured survey of research ethic committee approval structures and processes in their countries, and linked these data to outcomes. Survey findings were reconfirmed or modified in 2017. Eighteen (...) countries participated in the study, recruiting 2257 patients from 160 ICUs. National practices differed widely in terms of composition of RECs, procedures and duration of the ethics approval process. Eight countries used a single centralised process for approval, seven required approval by an ethics committee in each participating hospital, and three required both. Outcomes of the application process differed widely between countries because of differences in national legislation, and differed within countries because of interpretation of the ethics of conducting research in patients lacking capacity. The RECs in four countries had no lay representation. The median time from submission to final decision was 1.5 months; in nine approval was received within 1 month; six took over 6 months, and in one 24 months; had all countries been able to match the most efficient approvals processes, an additional 74 months of country or institution-level recruitment would have been available. In three countries, rejection of the application by some local RECs resulted in loss of centres; and one country rejected the application outright. The potential benefits of the single application portal offered by the European Clinical Trials Regulation will not be realised without harmonisation of research ethics committee practices as well as national legislation. ObjectiveBulimia nervosa and binge eating disorder are eating disorders characterized by recurrent binge eating episodes. Overlap exists between ED diagnostic groups, with BE episodes presenting one clinical feature that occurs transdiagnostically. Neuroimaging of the responses of those with BN and BED to disorder-specific stimuli, such as food, is not extensively investigated. Furthermore, to our knowledge, there have been no previous published studies examining the neural response of individuals currently experiencing binge eating, to low energy foods. Our objective was to examine (...) the neural responses to both low energy and high energy food images in three emotive categories in BN and BED participants.MethodsNineteen females with BN or BED, comprising the binge eating group, and 19 age-matched healthy control ’s completed thorough clinical assessment prior to functional MRI. Neural response to low energy and high energy foods and non-food images was compared between groups using whole-brain exploratory analyses, from which six regions of interest were then selected: frontal, occipital, temporal, and parietal lobes; insula and cingulate.ResultsIn response to low energy food images, the BEG demonstrated differential neural responses to all three low energy foods categories compared to HCs. Correlational analyses found a significant association between frequency of binge episodes and diminished temporal lobe and greater occipital lobe response. In response to high energy food images, compared to HC’s, the BEG demonstrated significantly decreased neural activity in response to all high energy food images. The HC’s had significantly greater neural activity in the limbic system, occipital lobe, temporal lobe, frontal lobe, and limbic system in response to high energy food images.ConclusionResults in the low energy food condition indicate that binge frequency may be related to increased aberrant neural responding. Furthermore, differences were found between groups in all ROI’s except the insula. The neural response seen in the BEG to disgust food images may indicate disengagement with this particular stimuli. In the high energy food condition, results demonstrate that neural activity in BN and BED patients may decrease in response to high energy foods, suggesting disengagement with foods that may be more consistent with those consumed during a binge eating episode. BackgroundThe ARRIVE (Animal Research: Reporting of In Vivo Experiments) guidelines are widely endorsed but compliance is limited. We sought to determine whether journal-requested completion of an ARRIVE checklist improves full compliance with the guidelines.MethodsIn a randomised controlled trial, manuscripts reporting in vivo animal research submitted to PLOS ONE (March–June 2015) were randomly allocated to either requested completion of an ARRIVE checklist or current standard practice. Authors, academic editors, and peer reviewers were blinded to group allocation. Trained reviewers performed outcome adjudication (...) in duplicate by assessing manuscripts against an operationalised version of the ARRIVE guidelines that consists 108 items. Our primary outcome was the between-group differences in the proportion of manuscripts meeting all ARRIVE guideline checklist subitems.ResultsWe randomised 1689 manuscripts (control: n = 844, intervention: n = 845), of which 1269 were sent for peer review and 762 (control: n = 340; intervention: n = 332) accepted for publication. No manuscript in either group achieved full compliance with the ARRIVE checklist. Details of animal husbandry (ARRIVE subitem 9b) was the only subitem to show improvements in reporting, with the proportion of compliant manuscripts rising from 52.1 to 74.1% (X2 = 34.0, df = 1, p = 2.1 × 10−7) in the control and intervention groups, respectively.ConclusionsThese results suggest that altering the editorial process to include requests for a completed ARRIVE checklist is not enough to improve compliance with the ARRIVE guidelines. Other approaches, such as more stringent editorial policies or a targeted approach on key quality items, may promote improvements in reporting. (shrink)

Alterations to cognitive function are often reported with depression and anxiety symptoms, yet few studies have examined the same associations with mental well-being. This study examined the association between mental well-being, depression and anxiety symptoms and cognitive function in 1502 healthy adult monozygotic and dizygotic twins, and the shared/unique contribution of genetic and environmental variance. Using linear mixed models, mental well-being was positively associated with sustained attention, inhibition, cognitive flexibility, motor coordination and working memory, whereas depression and anxiety symptoms were (...) associated with poorer sustained attention, inhibition, cognitive flexibility and executive function. Bivariate twin modelling showed well-being shared a small environmental correlation with motor coordination and a small genetic correlation with working memory. Trivariate twin modelling showed well-being shared a small genetic correlation with inhibition, whereas depression and anxiety symptoms shared a small environmental correlation with inhibition. The remaining variance was mostly driven by unique G and/or E variance. Overall, well-being and depression and anxiety symptoms show both independent and shared relationships with cognitive functions but this is largely attributable to unique G or E variance and small shared G/E variance between pairs of variables. On June 11, 1963, in a dramatic gesture that caught the nation's attention, Governor George Wallace physically blocked the entrance to Foster Auditorium on the University of Alabama's campus. His intent was to defy Attorney General Nicholas Katzenbach, sent on behalf of the Kennedy administration to force Alabama to accept court-ordered desegregation. After a tense confrontation, President Kennedy federalized the Alabama National Guard and Wallace backed down, allowing Vivian Malone and James Hood to become the first African Americans to enroll (...) successfully at their state's flagship university. That night, John F. Kennedy went on television to declare civil rights a "moral issue" and to commit his administration to this cause. That same night, Medgar Evers was shot dead. In The Schoolhouse Door, E. Culpepper Clark provides a riveting account of the events that led to Wallace's historic stand, tracing a tangle of intrigue and resistance that stretched from the 1940s, when the university rejected black applicants outright, to the post-Brown v. Board of Education era. We are there in July 1955 when Thurgood Marshall and lawyers at the NAACP Legal Defense Fund win for Autherine Lucy and "all similarly situated" the right to enroll at the university. We are in the car with Lucy in February 1956 as university officials escort her to class, shielding her from a mob jeering "Lynch the nigger," "Keep 'Bama white," and "hit the nigger whore." Clark exposes the many means, including threats and intimidation, used by university and state officials to discourage black applicants following the Lucy episode. And he explains how University of Alabama president Frank Anthony Rose eventually cooperated with the Kennedy administration to ensure a smooth transition toward desegregation. We also witness Robert Kennedy's remarkable face-to-face plea for Wallace's cooperation and the governor's adamant refusal: "I will never submit voluntarily to any integration in a school system in Alabama." As Clark writes, Wallace's carefully orchestrated surrender would leave the forces of white supremacy free to fight another day. And the Kennedys' public embrace of the civil rights movement would set in motion a political transformation that changed the presidential base of the Democratic party for the next thirty years. In these pages, full of courageous black applicants, fist-shaking demonstrators, and powerful politicians, Clark captures the dramatic confrontations that transformed the University of Alabama into a proving ground for the civil rights movement and gave the nation unforgettable symbols for its struggle to achieve racial justice. I argue for the existence of intrinsic Finks, Masks, and Mimics, and argue that these undermine certain recent attempts to revive simple conditional analyses of dispositions. I present some examples of intrinsic Finks, Masks, and Mimics, and argue that the example of an intrinsic fink I present has certain advantages over the examples of intrinsic finks recently suggested by Randolph Clarke. I conclude that the existence of such Finks, Masks, and Mimics, undermine a recent attempt by Sungho Choi to distinguish (...) dispositional properties from categorical properties. (shrink)

We examine the theory of the extended mind, and especially the concept of the “parity principle” (Clark and Chalmers in Analysis 58.1:7–19, 1998), in light of Hegel’s notion of objective spirit. This unusual combination of theories raises the question of how far one can extend the notion of extended mind and whether cognitive processing can supervene on the operations of social practices and institutions. We raise some questions about putting this research to critical use.

Every few years Andy Clark writes a book designed to help philosophers of mind get up to speed with the most recent developments in cognitive science. In his first two such books, Microcognition (1989) and Associative Engines (1993), Clark introduced the then-cutting-edge field of connectionist networks. In his newest one, Being There: Putting Brain, Body and World Together Again (1997), he once again provides a concise, readable introduction to the state of the art. This time, though, Clark (...) has moved beyond (but not abandoned) connectionism for what he calls 'embodied, active cognition,' in which the primary focus of study is not the inner workings of the rational thinker, but rather the way the autonomous, embodied agent interacts with its environment. A magisterial exploration of poetry’s place in the fine arts by one of the twentieth century's leading poets In this book, eminent poet Anthony Hecht explores the art of poetry and its relationship to the other fine arts. While the problems he treats entail both philosophic and theoretical discussion, he never allows abstract speculation to overshadow his delight in the written texts that he introduces, or in the specific examples of painting and music to which he refers. After discussing (...) literature’s links with painting and music, Hecht investigates the theme of paradise and wilderness, especially in Shakespeare’s The Tempest. He then turns to the question of public and private art, exploring the ways in which all the arts participate in balances between private and public modes of discourse, and between an exclusive or elitist role and the openly political. Beginning with a discussion of architecture as an illustration of a more general theme of discord and balance, the penultimate lecture probes the inner contradictions of works of art and our reactions to them, while the final piece concerns art and morality. We propose to extend Clark and Chalmer’s concept of the extended mind to consider the possibility that social institutions (e.g., legal systems, museums) may operate in ways similar to the hand-held conveniences (notebooks, calculators) that are often used as examples of extended mind. The inspiration for this suggestion can be found in the writings of Hegel on “objective spirit” which involves the mind in a constant process of externalizing and internalizing. For Hegel, social institutions are pieces of the mind, (...) externalized in their specific time and place. These institutions are the products of shared mental processes. We then use these institutions instrumentally to do further cognitive work, for example, to solve problems or to control behavior. (shrink)

The Phenomenological Mind, by Shaun Gallagher and Dan Zahavi, is part of a recent initiative to show that phenomenology, classically conceived as the tradition inaugurated by Edmund Husserl and not as mere introspection, contributes something important to cognitive science. (For other examples, see “References” below.) Phenomenology, of course, has been a part of cognitive science for a long time. It implicitly informs the works of Andy Clark (e.g. 1997) and John Haugeland (e.g. 1998), and Hubert Dreyfus explicitly uses it (...) (e.g. 1992). But where the former use phenomenology in the background as broad context and Dreyfus uses it primarily (though not exclusively) as a critique of conventional AI, Gallagher and Zahavi wish to indicate a positive and constructive place for it within cognitive science. They do not recommend that we simply accept pronouncements of thinkers like Husserl, Heidegger, Sartre and Merleau‐Ponty and apply them to questions of cognition, but that we use revised forms of phenomenology to illuminate dimensions of cognitive experience that are missing in current research. The book is presented as an “introduction to philosophy of mind and cognitive science” written from a phenomenological perspective. It seeks to justify the use of phenomenology in cognitive science by showing what kinds of questions it asks and answers, the variety of uses to which it has recently been put and the fruitfulness of some of its findings. The catalog of topics, for the most part, matches other introductions to the philosophy of mind, such as questions of method, consciousness, perception, intentionality, embodiment, action, agency and other minds. One issue presented here that is not generally dealt with in existing philosophy of mind and cognitive science texts is temporality, a mainstay of the continental tradition. After an introductory chapter that places phenomenology in the context of other approaches, the book lays out the main tenets of phenomenological method. Here, one encounters expected components of phenomenology: the epoché (described below), phenomenological reduction, eidetic variation, and so on. This traditional fare is soon followed by some potential surprises, namely, attempts to “naturalize” phenomenology, a few attempts to formalize it, and the emergence of ‘neurophenomenology’. Each of these is a bit surprising because Husserl was a vocal critic of naturalism, seeing transcendental phenomenology as an alternative to the empirical study of consciousness. He was also skeptical about the possibilities of mathematizing phenomenology. Gallagher and Zahavi acknowledge these points, but since they are not repeating history or undertaking exegesis, strict adherence to canonical phenomenology is not required. Against John Martin Fischer, I argue that the Basic Argument does not rely on the premise that an agent can be responsible for an action only if he is responsible for every factor contributing to that action. Against Alfred Mele and Randolph Clarke, I argue that it is absurd to believe that an agent can be responsible for an action when no (...) factor contributing to that action is up to that agent. Against Derk Pereboom and Clarke, I argue that the versions of agent-causal libertarianism they claim can immunize the agent to the Basic Argument actually fail to do so. Against Robert Kane, I argue that the Basic Argument does not rely on the premise that simply the presence of indeterministic factors in the process of bringing an action about is itself what rules out the agent’s chance for being responsible for that action. A decade after developing a modal cosmological argument for God's existence and attributes, Samuel Clarke (1675–1729) debated Leibniz on miracles, divine freedom, and the nature of the world. Clarke's theories of freedom, divine activity, the soul, and ethics influenced Joseph Butler, Jonathan Edwards, David Hume, Thomas Reid, and many others. His attacks on the materialism, pantheism, and “atheism” of Thomas Hobbes, Spinoza, John Toland, Anthony Collins, and the deists were interwoven with his defenses of Newtonian natural philosophy, which he (...) was largely responsible for popularizing. His research on and theory of the Trinity was a milestone of early eighteenth-century philosophical theology. (shrink)

Can room be found in between the matter and void of a Newtonian universe for an immaterial and immortal soul? Can followers of Locke with his agnosticism about the nature of substances claim to know that some of them are immaterial? Samuel Clarke, well versed in Locke's thought and a defender both of Newtonian science and Christian orthodoxy, believed he could do both and attempted to prove his case by means of some hard-boiled reductionism. In this paper I discuss their controversy' in order to bring out the state of debate about material systems and consciousness among people influenced by Locke and Newton in the early eighteenth century, and I also assess Clarke's reductionist premise, as he himself frequently invites "the impartial reader" to do. Anthony Collins (1676-1729) maintains that consciousness might be a material process or result from material processes. On the one hand, Collins accepts Locke’s view that from consciousness, i.e., the activity of thinking, we acquire no knowledge about the nature of the thinking substance. On the other, he takes seriously Samuel Clarke’s challenge that the thinking substance must be suitably unified because consciousness is unified. In this paper, I argue that, throughout his correspondence with Clarke, Collins maintains that consciousness signifies (...) actual thinking and does not refer to the capacity of thinking. His main materialist thesis is that the powers of parts of material systems can bring about unified powers and that the power of thinking may be such a power. Collins attempts to satisfy the unity requirement by arguing that a unity correspondence can obtain between consciousness and the power of thinking that is realized in a material composite. (shrink)

In the past, experts have disagreed about whether Samuel Clarke accepted the idea that gravity is a power superadded to matter by God. Most scholars now agree that Clarke did not support superaddition. But the argumentation employed by Clarke to reject superaddition has not been studied before in detail. In this paper, I explicate Clarke's argumentation by relating it to an important discussion about the possibility of superadded gravity in the Clarke-Collins correspondence. Anthony Collins is known mostly as an eighteenth-century freethinker who contributed to ideas of rational religion and religious toleration, as a close friend of John Locke, and as a necessitarian and materialist who held a significant correspondence with Samuel Clarke. Yet, his political philosophy has rarely received serious attention, and he remains a neglected figure in the history of political thought. This article attempts to recover Collins as a philosopher who developed a complex political theory, by focusing on his (...) conceptions of liberty and authority. It shows that he conceptualised liberty, and liberty of thought in particular, both as non-interference and non-domination, namely, an absence of censorship as well as an absence of continuous tyranny over the minds of humankind. Then, it shows that Collins also developed a thorough idea of civil authority, according to which even religious liberties may depend in some cases on the discretion of the civil sovereign. Finally, this article suggests that Collins’s multi-layered theory continued to develop after his lifetime, and that he therefore had a prominent place in eighteenth-century debates of liberty and authority. The correspondence between Samuel Clarke and Anthony Collins of 1706–8, while not well known, is a spectacularly good debate between a dualist and a materialist over the possibility of giving a materialist account of consciousness and personal identity. This article puts the Clarke Collins Correspondence in a broader context in which it can be better appreciated, noting that it is really a debate between John Locke and Anthony Collins on one hand, and Samuel Clarke and Joseph Butler on (...) the other. Anthony Collins argues on behalf of John Locke's claim that it would be as easy for God to superadd the power of thinking to matter as for him to connect a soul to a body. Locke did not believe that matter could naturally produce thought or consciousness, but it was in God's power to make matter think. To defend Locke's claim Collins must defend the claim that there are emergent properties in the world – properties of a whole that are not possessed by the parts. Collins also defends a materialist version of Locke's account of personal identity against a variety of charges. Because the topics of debate in the correspondence are of such great interest to us, it deserves to be rescued from the neglect into which it fell and from which intellectual historians and philosophers have only recently and partially removed it. It is now more than six years since the Global Financial Crisis threatened to topple the banking systems of the Western world. Although a complete breakdown in the financial system was ultimately avoided, one consequence of the events of 2008 has been the biggest slump in economic activity since the Great Depression. Australia was, in the main, spared the economic damage that ravaged large parts of Europe, and there has been little discussion in these parts of the causes and social (...) effects of what the authors refer to as the 'Great Recession'. Somewhat surprisingly, on the evidence presented in this book it would seem that the Anglosphere at large is guilty of what the authors call the 'veil of complacency'. The book asserts that in those countries there is little concern for either the financial consequences or the victims of the crisis. Why should this be the case? Perhaps the Great Recession was not as bad as the headlines have suggested. (shrink)
